Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CalzTrack mobile application and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have obtained consent from a parent or legal guardian. By using the Service, you represent that you have the legal capacity to enter into these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions & Purchases

The Service offers both free and paid subscription tiers. Paid subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. You can manage subscriptions through your device settings or Apple App Store/Google Play Store account settings. Refunds are handled by the respective app store in accordance with their policies.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Attempt to circumvent any subscription or usage limitations;
• Upload or transmit viruses, malware, or any malicious code;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to reverse engineer, decompile, or extract source code from the Service;
• Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our prior written consent.

5. User Content

You retain ownership of the content you submit through the Service (including meal photos, descriptions, and health data). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to analyze meal photos and descriptions to estimate nutritional information. AI-generated nutrition estimates may be inaccurate or incomplete. You should use your best judgment and consult qualified professionals for medical or dietary advice. The Service is not a substitute for professional medical advice, diagnosis, or treatment.

7. Health Disclaimer

The Service provides general nutrition tracking and is not intended to diagnose, treat, cure, or prevent any disease or health condition. You should consult a qualified healthcare provider before making any dietary changes. Calorie and nutrition estimates are approximations and should not be relied upon for medical decision-making.

8. Intellectual Property

The Service, including its code, design, branding, and proprietary algorithms, is owned by CalzTrack and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Third-Party Services

The Service may integrate with third-party services (e.g., Apple Health, Google Fit, OpenAI). We are not responsible for the content, privacy practices, or actions of these third parties.

10. Limitation of Liability

To the maximum extent permitted by law, CalzTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of Hong Kong.
